Opinion, manuscript, legal. Case on behalf of Limerick Philosophical & Literary Society (against John Duggan, contractor, re society building) for opinion of Gerald Fitzgibbon, 2 Nov 1842. Signed and dated by Fitzgibbon 26 Jan 1843. Five sheets bound and tied with waxed paper top l. Copperplate handwriting states history of the building as 5158, and poses questions. 1. Are the shareholders, committee or trustees collectively or individually liable for the balance due to the contractor. 2. Can the contractor exclude the society from the building, and if so, is he liable for the rest. 3. Has he any other and what remedy to establish a lien on the building. 4. Is he entitled to interest on the balance, and will his shutting up the building disentitle him to it. Wide margin l. for Fitzgibbon's replies, all negative, which fill two further pages, leaving three (including cover) blank. Pages 1-5 numbered. Folded twice, titled on resulting front. Fee L2.2.0 initialled by Fitzgibbon, and added by him: Pd. George Westropp / for Pain? from Dublin 2/-, making total L2.4.0. Initialled below G.J.H., and copperplate inscribed Westropp. No watermarks.
